Terms and conditions

  1. The general conditions are an integral part of any contract signed between the parties designated below.
     

A. The parties
 

  1. The Location2roues company with its registered office in Savièse, hereinafter the lessor, and any person renting a vehicle from Location2roues, hereinafter the lessee.
     

B. Age of tenant
 

  1. The minimum age of the tenant is set at 18 years old. Some vehicles may have a different minimum age. The legal limits must in all cases be observed. For children (under 18) parental authorization is required and the rental contract must be signed by their legal representative.
     

C. Tenant's commitment
 

  1. The tenant agrees to provide accurate information about his person. 

  2. He undertakes to respect the quotes made by our partners for mechanical damage and bodywork.

  3. He also undertakes to respect the rules of road traffic.
     

D. Geographical limitation of vehicle use
 

  1. The vehicle can only be used in Switzerland. The other countries are excluded. Except in the event of prior written authorization from the lessor.

  2. For legal reasons, student drivers cannot leave Swiss borders.
     

E. Bad weather
 

  1. Rental takes place in all weathers. 

  2. The lessor can decide, depending on the situation at the departure of the vehicle, to cancel or postpone the rental.

  3. These situations can be:
     

  • The snow

  • A storm

  • Hail

  • Various dangers
     

F. Prices
 

  1. The rates in force are those indicated on the website at the time of confirmation of the reservation.

  2. The packages agreed between the lessor and the lessee may have particular conditions and special prices. They cannot be changed.

  3. All prices can be changed at any time by Location2roues and are valid as soon as they are published on the website.


G. Gift vouchers
 

  1. Gift vouchers are valid for one year. They are personal and non-transferable.
     

H. Use of included kilometers
 

  1. Rental days include a certain number of kilometers listed on the rental agreement.

  2. The kilometers included are deemed to be used as soon as a reservation is initiated or lost.

  3. The actual kilometers remaining cannot be carried over to a subsequent reservation. 

  4. Each kilometer in addition to those included for the reservation will be charged at the rate indicated on the rental agreement.


I. Reservation of a vehicle
 

  1. Reservations are confirmed by e-mail.

  2. Once confirmed, the tenant has a cooling-off period of 48 hours after making their reservation to modify or cancel their reservation by e-mail only. Once this deadline has passed, the cancellation conditions apply (cf. Reservation cancellation).

  3. Reservations are part of a rental contract. Upon confirmation of the first reservation, the contract must be paid in full (cf. Rental contract).

  4. Only one reservation is possible at a time. Exception: compulsory courses and the practical exam. The lessor reserves the right to request proof of registration.


J. Cancellation of a reservation
 

  1. The deadline for canceling a reservation is indicated on the website on the ″ Home ″ page. After this period, the reservation is final.

  2. In cases where the cancellation takes place on time, the tenant can move their reservation or request a refund only once.

  3. Refunds are made only via gift vouchers valid for 1 year.

  4. A definitive reservation is considered to be used. If it is canceled, it is completely lost and the tenant cannot claim reimbursement for it.


K. Caution
 

  1. A deposit must be deposited by the tenant before taking the vehicle. The amount of the deposit is CHF 500.

  2. The deposit is made in cash, by wire transfer or by credit card. In the event of a deposit by bank transfer or by credit card, the lessor reserves the right to charge a processing fee.

  3. The deposit is returned on return of the vehicle only if it returns as it was given. Otherwise, the full amount of the deposit is retained to pay the first costs related to the damage (processing fees of CHF 200 included).


L. Rental contract
 

  1. The rental contract indicates all the elements allowing the identification of the tenant, the category of the motorcycle, the actual amounts of the franchise and the deposit, the number of days and kilometers included, the price of the additional kilometer and the amount. total.

  2. Other information may be included in the rental agreement.

  3. A rental contract can only be used if it is paid in full. Otherwise, the tenant may lose his reservation and must pay the contract in full.

  4. The total amount of the contract must be paid in full before the departure of the vehicle.


M. Validity of the contract
 

  1. Rental contracts are valid for one season and end automatically on December 31 of each year.

  2. The days included in the contract and not used are lost.


N. Vehicle condition check
 

  1. A check of the condition of the vehicle is carried out upon collection and return by the lessor and the lessee together, and the damage present on the vehicle is recorded in the rental contract and then signed by the lessee.

  2. All damage to the return that was not reported when picking up the vehicle is the responsibility of the tenant. A copy of the rental contract is given to the tenant before the departure of the vehicle.


O. Pick up and return of the vehicle
 

  1. The pick-up and return of the vehicle are made at the rental agency at the times indicated in the reservation.

  2. In the event of a delay of a quarter of an hour or more, for each quarter of an hour started, a supplement will be charged.
     

P. Condition of the vehicle upon collection and return
 

  1. The lessor provides a vehicle in working order, full of fuel, and clean. If this is not the case, the lessor consents it in writing on the rental contract made at the departure of the vehicle.

  2. On return, the vehicle must be in the same condition as when it was picked up and the lessor agrees not to ask the lessee to return the vehicle in better condition than at the start of the rental.

  3. Any lessee who returns the vehicle in poorer condition than the one in which he picked it up will be charged a repair fee.


Q. Vehicle maintenance during rental
 

  1. The tenant agrees to maintain the vehicle as best he can. 

  2. The renter is fully responsible for any consequences due to negligence such as failure to check oil, water, tire profile or pressure, chain tension and lubrication. In addition, the lessee is responsible for all damage resulting from filling the tank with unsuitable fuel. 

  3. If damage is caused by breach of his duties the tenant will be responsible for their repairs.

  4. If a lessee notices that the vehicle is not in order, he must notify the lessor as soon as possible.  


R. Use of the vehicle
 

  1. Rented vehicles can only be used on roads and paths authorized for traffic. 

  2. It is strictly forbidden to use vehicles:
     

  • For commercial use.

  • To re-let them.

  • Under the influence of alcohol, drugs, medication or doping agents.

  • In case of fatigue.

  • To participate in sporting events or other races.

  • For compulsory non-course training courses with an approved instructor.

  • On circuit.

  • In the forest roads.

  • Off-road in general.
     

S. Highway and vignette
 

  1. Only vehicles over 125 cm3 can travel on the motorway and are equipped with the motorway sticker.

  2. The use of the motorway is only possible if the vehicle is equipped with a motorway sticker.

  3. The use of the motorway is prohibited for people who do not have a definitive license for the category.
     

T. Vehicle insurance
 

  1. All vehicles are insured for civil liability with excess, natural events, fire, theft and breakdown assistance.

  2. Only the vehicle is insured. The accessories are not covered by the insurance and in case of damage, loss or theft of these, the tenant is held responsible.
     

U. Franchises
 

  1. The tenant's effective deductible is CHF 2,000. It is per case and at least CHF 2,000. It is always the same amount. The handling fees of CHF 200 in the event of claims or falls are extra

  2. The excess is not applicable in the event of serious faults (cf. Serious faults), and in this case the full amount of the damage is the responsibility of the tenant.
     

V. Deductibles in the event of multiple drivers
 

  1. It is forbidden to allow the vehicle to be driven by a third person, except with the prior agreement of the lessor.

  2. In the event of an accident involving the third party, without prior agreement, the deductible is CHF 2,000, except for serious faults (see Serious faults)
     

W. Serious faults
 

  1. Serious offenses are defined by law (cf. LCR art. 16c)

The following cases are also considered serious misconduct:
 

  • the use of vehicles in places prohibited by these general conditions (see Use of the vehicle).

  • taking a vehicle without previous experience and without taking a course with a driving instructor.

  • allow the vehicle to be driven by a third party who does not have the required license or experience.


X. Damage to the vehicle
 

  1. All damage to the vehicle and accessories and related costs are the responsibility of the tenant. 

  2. The amount of the excess indicated in the rental contract is applicable only for those imposed on the vehicle.

  3. In the event of damage, a handling fee of CHF 200 will be billed to the tenant. These costs are exclusive of the deductible.

  4. As part of the course, the vehicle may be covered by collision insurance. If this is the case, the tenant is held responsible for turning to the course business.

  5. If the vehicle is destroyed or considered to be in total damage by the insurance, the lessee must pay the lessor the full amount of his deductible unless he has committed a serious fault (cf. Serious fault). 

  6. In the event of serious misconduct, the lessee must pay the amount allowing the redemption of the vehicle as well as the costs. The lessor reserves the right to claim damages.
     

Y. Flat tire
 

  1. The puncture of a tire is the responsibility of the renter.

  2. Depending on the condition of the tire, the rental company will decide to repair or replace it. The costs will be billed to the tenant.

  3. In the event of replacement of a tire, the amount invoiced to the tenant is inversely proportional to the wear of the tire, the costs of the partner garage in addition. Wear is determined by the garage.

  4. In the event of repair of a tire, a fixed price will be requested.

  5. The lessee can have the tire changed himself at his own expense at the garage of his choice with the prior agreement of the lessor. He can only put on another type of tire than the punctured one with the agreement of the lessor.
     

Z. Service, breakdown and repair of the vehicle during the rental period
 

  1. In the event of service, change of parts or repair of the vehicle by the lessee, the lessor must have given his prior consent.

  2. In the event of a breakdown, the tenant will first contact the lessor and then follow the instructions provided by the Axa Winterthur breakdown service.

  3. All repairs, with the agreement of the lessor, must be invoiced in the name of the company and paid for by the lessee. 

  4. Loss of time or other indirect damage caused by a breakdown or repair will not be covered by the lessor.
     

AA. Accident, theft, other damage and fine
 

  1. The tenant must immediately notify the landlord in the event of:
     

  • accident,

  • flight,

  • of loss,

  • fire,

  • damage caused by game,

  • other damage 

and have a police report drawn up.  
 

  1. The tenant must, even in the event of minimal damage, immediately report it to the lessor, with an explanatory sketch of the causes of the loss. In the event of the involvement of third parties, a European accident report must be completed and in particular include the name and address of the persons involved and any witnesses, as well as the registration numbers of the vehicles involved.

  2. In the event of theft, loss or misappropriation of the vehicle, the lessor and the police must be informed immediately. The keys to the vehicle, the report on the progress of the theft and the police report must be given to the rental company within 24 hours of the theft. The tenant authorizes the lessor to consult all the necessary files with all the departments.

  3. In the event of a fine for speeding or general law violations, the tenant authorizes the landlord to send the rental contract and the tenant's personal data to the departments concerned.
     

AB. Illness, accident and various impediments
 

  1. Cases of illness, accident, transport problem or professional imperative are not the responsibility of the lessor. The tenant must request reimbursement for his rental from his health, accident or travel insurance. For these cases, the lessor can provide a certificate of payment and late cancellation.
     

AC. Derogation from these general conditions
 

  1. The lessor reserves the right to derogate from these conditions in favor of the lessee. Only the written exemptions signed by the lessor are valid.
     

AD. Case not described in the general conditions
 

  1. If an indication appears on our rental agreement, this indication acts as a condition.

  2. In other cases, the lessor and the lessee must show good faith.
     

AE. Liability of the lessor
 

  1. The lessor has no responsibility towards the lessee or third parties for accidents or damages which occur during the duration of the rental. Likewise, the lessor is not liable for damage due to defects in the vehicle. All responsibilities on the part of the lessor are excluded.
     

AF. Place of jurisdiction and applicable law
 

  1. For any dispute that may arise with respect to this rental contract and the interpretation of the general conditions, the parties agree on the legal venue of the company's headquarters in Savièse and the application of Swiss law.
